TERMS OF SERVICE

 

Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using https://jyanyoga.com (“the Site”) operated by Jyan Pte Ltd. (“us”, “we,” or “our”) and for participation in activities at our Jyan Yoga Studio (“Facility”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://jyanyoga.com and for your participation of activities at our Facility. Furthermore, please take note that we will be integrating a third-party partner, Momence (“the App”) to facilitate the hassle-free booking of classes.

 

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. By participating in any activities and usage of amenities in the Facility, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for use of the Jyan Yoga Studio’s services. You are only authorized to use the Jyan Yoga Studio’s services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service.

 

Please read these Terms of Service carefully. If you do not agree with it, you should leave Jyan Yoga website and discontinue use of Jyan Yoga services immediately. If you wish to become a Member, you must read these Terms of Service and indicate your acceptance during the registration process.

 

 

CHANGES TO THIS AGREEMENT

 

Jyan Yoga Studio reserve the right to modify these Terms and Conditions by updating the terms on the Site at our sole discretion. The Agreement may be revised at any time by updating this posting. By your continued use of the Site, buying Jyan Yoga Studio packages, booking classes, buying merchandise, your communication with Jyan Yoga Studio, and your use of and attendance of Jyan Yoga Studio, constitutes your acceptance of the new Terms and Conditions.

 

We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement, or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

ACCOUNTS
 

You will have to create an account on the Momence App in order to access your account. When creating an account, you must provide accurate and complete information. You are solely responsible for all the activities that occur on your account and you must keep your account password secure. You must notify us immediately, should you notice any breach of security or unauthorized use or access of your account. You may never use another person’s account without permission.

 

 

MEMBER SERVICES & POLICIES

 

  1. Buying Packages
    – You must create an account on Momence before any package can be purchased. You may purchase a package online, or directly at our studios. The package will commence one month from the date of purchase after a confirmation email of the purchase has been sent to your account email.
     

  2. Sharing Packages
    – Only selected packages are shareable between Jyan Yoga Studio’s members. Please refer to the page here for the package information. Payment for the package must be made before the sharing process can be executed. Please contact us via email at hello@jyanyoga.com to initiate the package sharing feature.
     

  3. Class Cancellations
    – You may cancel your class booking via your registered account on the Momence app or drop an email to hello@jyanyoga.com. In the event of a late cancellation or no-show, the credit will NOT be refundable. The 6-hour cancellation period is also applicable for cancellations made via email.
     

  4. Class Reservations
    – All class reservations must be done through our third party online class booking system. You must be physically present within the studio 5 minutes before the commencement of the reserved class. If you are late and the reserved class has commenced, you will be denied access into the class as safety concern is our number one priority in the studio and your class credit will be deducted.
     

  5. Waiting List
    – If a class is fully booked, you can still reserve a spot for a class and you will be added to the waitlist. If you are at the top of the waitlist and have arrived at the studio to wait for a no-show, you will be allocated a spot if a pre-booked spot is not claimed within 5- minutes before class starts. Your credit will only be deducted if you are able to join the class.
     

  6. Personal Belongings
    – You agree that Jyan Yoga Studio is in no way responsible for the safekeeping of your personal belongings when you are present in the studio. You assume your own personal responsibility and all risk of loss for any of your personal belongings.


 

STUDIO RULES & REGULATIONS

 

You shall adhere to the rules of Jyan Yoga Studio within the Facility and the classes conducted with the equipment in the Facility.

 

You must be physically present and checked in at least 5 minutes prior to the start of class or your spot may be released to a waitlist member. We practice a strict closed-door policy whereby entry to the class will NOT be permitted once the class doors are closed. This is to ensure the safety of all members as in-class safety briefing is conducted 5 minutes before class starts.

 

Reserved classes must be changed or cancelled 6 hours before the scheduled class time or your credit will be forfeited.

 

By participating in our classes, you hereby agree that you are physically fit and well to participate. You are solely responsible to seek medical advice if required prior, to decide whether or not the Facility or the classes would be suitable for you, having regards to your personal health condition. By participating in our classes, you agree to adhere to the instructions given by our Instructors during class.

 

We will not be liable for any failure to obtain access to our Facility or usage of the Facility beyond the reasonable control of Jyan Yoga Studio. Any refund of the usage fee will be subject to the sole discretion of Jyan Pte. Ltd.

CLASSES, CLASS PACKAGES & MEMBERSHIPS

 

Purchases of classes, Class Packages and Memberships can be made online on the Momence Website or through the Momence App. If you choose to make a payment using credit/debit cards through the Momence Website or App, please note that a card fee will apply. This fee is non-refundable. Alternatively, payments can be made in studio for classes, Class Packages and Memberships. All upfront payment (12 months unlimited & student 6 months unlimited) needs to be paid via bank transfer (PayNow) only. We accept payments via Visa and MasterCard if you make your purchase through the Jyan Yoga Website or App. We only accept PayNow payment if you make your purchase in studio. All passes, Class Packages and Memberships will start on the first day you make your first class booking. You can view all Jyan Yoga classes and class prices on the Momence App or Jyan Yoga Website.

 

You cannot gift your classes, redeem them for cash, or onsell them outside of Jyan Yoga. Any classes or Class Packs that have been purchased anywhere other than Jyan Yoga will not be honored.

 

Classes do expire. The expiration dates of your Class Packages can be found under the ‘Memberships > My Memberships’ section on the Momence Website and the ‘Account > My Memberships’ section of the Momence App. The validity will also be clearly stated on your Class Packages purchase receipt. These validities vary based on Class Pack sizes. Promotional Class Packs may also carry different validity periods. We will send an email notification to the address assigned to your profile a month before the expiration of your package.  

 

Future class prices are subject to change, however, Jyan Yoga will honor your class or series of classes until the expiration date and no longer.

 

For Trial pass & Promo packages

  • strictly non-extendable, non-shareable, non-transferable & non-refundable.
     

For Class Packages

  • strictly non-shareable & non-refundable.

  • to freeze or extend your package due to medical condition or travel plans, do provide a doctor’s note or flight tickets respectively.

  • you may transfer class pack in full to another person at a processing fee of $50. if the package is bought at a discounted rate which the transferee is not entitled to, he/she will have to top up the difference.
     

For Memberships

  • all memberships paid monthly are non-refundable in part or full after auto-draft has gone through under any circumstances.

  • membership commences on the date of sign up and amount will be charged on that date of month each month unless otherwise discussed.

  • memberships paid upfront are not refundable under any circumstances.

  • all memberships paid monthly will renew automatically month to month. for cancellations, holds, and/or changes to memberships for any reason, members must notify us via email at hello@jyanyoga.com at least one month prior and there will be an early termination fee of $248 if you decide to cancel your membership before the contract expires.

  • card fee applies for monthly recurring auto-debit.

  • please note that we are unable to backdate any package/ membership freeze requests. members must request for membership freeze or extension in advanced for the desired time.

 


RETAIL & MERCHANDISE

 

All retail and merchandise sales are non-refundable at Jyan Yoga. All merchandise, with the exception of sale items (if any), may be exchanged within seven (7) days of the initial purchase date, as long as the product is unused and unsoiled, with all tagging still intact. 

 

Jyan Yoga will occasionally, at its own discretion, conduct sales on Jyan Yoga Merchandise and other products. All sales on discounted product are final. Exchanges are not offered on sale products.

 

 

WAIVER & RELEASE

 

The below section refers to Waiver & Release which takes effect upon when you have registered an account with Jyan Yoga Studio using our third party partners, Momence.

 

In consideration of the risk of injury that exists while participating in the classes provided in Jyan Yoga (hereinafter the “Activity”), I hereby knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity.

 

I am voluntarily participating in the aforementioned activity and I am participating in the activity entirely at my own risk. I am aware of the risks associated with participating in the Activity, which may include, but not limited to: physical or psychological injury, pain, suffering, illness, temporary or permanent disability (including paralysis), economic or emotional loss and death. I understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel to and from the Activity, or from conditions at the Activity location(s). Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this Activity.

 

This waiver and release of liability shall remain in effect for the duration of my participation in the Activity, during this initial and all subsequent events of participation.

 

I hereby release and waive any claims, any loss, liability, or demand, that I may have hereafter against Jyan Yoga, its owner, employees, and instructors.

 

 

INTELLECTUAL PROPERTY

 

The Site contains material, such as software, text, graphics, images, designs, sound recordings, audiovisual works, and other material provided by or on behalf of the Company [collectively referred to as the “Content”].

 

The Content may be owned by the Company or authorised third parties. Any unauthorized use of the Content may violate copyright, trademark, and other laws. The use or posting of the Content on any other website or in a networked computer environment for any purpose is expressly prohibited.

 

The trademarks, service marks, and logos of the Company used and displayed on the Site are registered and unregistered trademarks or service marks of the Company. Nothing on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use the aforementioned marks without our prior written permission specific for each such use.

 

No Content shall be retransmitted or reproduced in any other form whether electronically or printed without the Company’s express, written consent for each and every instance.

 

 

CHOICE OF LAW

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore and shall be subject to the exclusive jurisdiction of Singapore.
